Terms of Service

These Terms of Service ("Terms") apply to your use of fivestarfunnel.co (the "Site"), the review pages we create, and any related services from Five Star Funnel ("we," "us," or "our"). Please read them carefully.

1. Agreement to these Terms

By using the Site or our services, you agree to these Terms and to our Privacy Policy. If you use our services on behalf of a business, you confirm that you have authority to accept these Terms for that business, and "you" includes that business. If you do not agree, please do not use the Site or our services.

2. Our services

Five Star Funnel creates branded review pages for businesses. A review page lets a business's customers choose a star rating. Customers who choose 4 or 5 stars are directed to the business's Google review page. Customers who choose 1 to 3 stars can send private feedback, which is emailed to the business owner. We may also provide links, QR codes, and setup help. We may update, improve, or change our services at any time.

3. No guarantee of results

Results are not guaranteed. We do not promise or guarantee any specific outcome from using our services, including:

  • the number of reviews you receive, or how often you receive them;
  • your star rating or the content of any review;
  • your position in Google Search, Google Maps, or the "Local Pack";
  • any increase in calls, website visits, leads, customers, sales, or revenue.

Results depend on many things we do not control, such as your customers' choices, the quality of your products and services, your competitors, and how Google ranks businesses. Any examples, estimates, or calculator results on the Site, including the Lost Revenue Calculator, are for illustration only. They are not predictions, promises, or financial advice.

4. Google and your Google Business Profile

Five Star Funnel is an independent service. We are not affiliated with, endorsed by, or sponsored by Google. Google, Google Maps, and Google Business Profile are trademarks of Google LLC.

We are not responsible for any issue with your Google Business Profile. Your profile is owned and managed by you and operated by Google under Google's own terms and policies. We are not responsible or liable for anything Google does or that happens to your profile, including:

  • suspension, restriction, disabling, or loss of your profile or Google account;
  • verification problems or changes to your business information;
  • reviews that are filtered, delayed, hidden, flagged, or removed;
  • changes to your rating, review count, visibility, or ranking;
  • changes to Google's products, policies, review links, or algorithms; and
  • outages, errors, or other problems with Google's services.

Google can change its products and policies at any time. Those changes may affect how our services work, and we may need to change or stop features as a result.

5. Your responsibilities

When you use our services, you agree that:

  • the information you give us, including your Google review link and email address, is accurate and kept up to date;
  • you own, or have permission to use, any names, logos, and other content you provide to us;
  • you alone decide how and when you ask customers for reviews, and you are responsible for making sure your review requests comply with Google's policies and with all laws that apply to you, including consumer protection laws and rules on reviews and endorsements (such as those of the U.S. Federal Trade Commission);
  • you will not offer payments, discounts, or other incentives in exchange for reviews, and you will not create, buy, or post fake reviews;
  • you will not use our services to send spam, mislead customers, or harass anyone; and
  • you are responsible for monitoring the email address where feedback is sent and for how you respond to customers.

6. Customer feedback

Private feedback submitted on your review page is sent to the email address you give us. We do not edit, verify, or moderate feedback, and we are not responsible for what customers write. We do not publish private feedback. We are not responsible for emails that are delayed, filtered as spam, or not delivered, so please keep your email address current and check your spam folder.

If you use the optional owner dashboard, saved feedback is kept for up to 12 months and daily statistics for up to 90 days, then deleted automatically. You can delete saved feedback at any time. Dashboard numbers are provided for your information and may not exactly match Google's own figures. You are responsible for keeping your dashboard password private.

7. Fees and payment

Prices, billing schedules, and any setup fees are set out in your quote, invoice, or written agreement with us. Unless that agreement says otherwise, fees are due when invoiced and are non-refundable, including for partial months. We may pause or stop services if payment is late. You are responsible for any taxes that apply to your purchase.

8. Cancellation and termination

You may cancel as described in your agreement with us, or at any time by emailing dylan@fivestarfunnel.co. We may suspend or end your services, with or without notice, if you break these Terms, do not pay, or use our services in a way that could harm us, your customers, or others. When services end, your review page, links, and QR codes may stop working. Sections that by their nature should continue (such as Sections 3, 4, 10, 12, 13, 14, and 15) survive termination.

9. Acceptable use of the Site

You agree not to misuse the Site. For example, you will not try to gain unauthorized access to it, interfere with how it works, submit automated or spam requests, scrape it in bulk, or use it for anything unlawful.

10. Intellectual property

The Site, our software, designs, text, and branding belong to Five Star Funnel and are protected by law. You keep ownership of your business name, logo, and content. You give us a limited, non-exclusive permission to use them only to provide our services to you, such as displaying your logo on your review page. We will not use your name or logo in our own marketing without your permission.

11. Availability and changes

We work to keep the Site and review pages available, but we do not guarantee they will always be available, uninterrupted, or error-free. They may be unavailable during maintenance or because of problems with hosting, email, internet, or other providers.

12. Disclaimer of warranties

THE SITE AND OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT OUR SERVICES WILL PRODUCE ANY PARTICULAR RESULT.

13. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, FIVE STAR FUNNEL WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, REVENUE, BUSINESS, CUSTOMERS, REVIEWS, RANKINGS, DATA, OR GOODWILL, OR FOR ANY HARM TO YOUR GOOGLE BUSINESS PROFILE, EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR OUR SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100) IF YOU HAVE NOT PAID US. Some places do not allow certain limitations, so some of these may not apply to you.

14. Indemnification

You agree to defend, indemnify, and hold harmless Five Star Funnel from any claims, losses, damages, and expenses (including reasonable attorneys' fees) arising from your use of our services, the content you provide, how you request or respond to reviews, or your violation of these Terms, Google's policies, or any law.

15. Governing law and disputes

These Terms are governed by the laws of the State of Maine, without regard to its conflict-of-law rules. Any dispute related to these Terms or our services will be brought in the state or federal courts located in Maine, and you agree to the jurisdiction of those courts. Before filing a claim, please contact us so we can try to resolve the issue informally.

16. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the "Last updated" date above. If you keep using the Site or our services after an update, you accept the updated Terms.

17. Other terms

If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with your quote, invoice, or written agreement with us and our Privacy Policy, are the entire agreement between you and us about our services. If they conflict, your written agreement with us controls.
